Michael Phelps Will Not Face Criminal Charges For Pot Picture in South Carolina. Olympic swimming champion Michael Phelps came really close to facing criminal charges in connection with a November party at which he was photographed using a bong.

Michael Phelps admitted “regrettable behavior” after a photo of him using a bong was published.

“We do not believe we have enough evidence to prosecute anyone,” stated Richland County Sheriff, Leon Lott. Lott told reporters that authorities are ending their investigation into Phelps.

“We had a photo, and we had him saying he was sorry for his inappropriate behavior,” Lott said. “That behavior could have been going to a party. … He never said, ‘I smoked marijuana.’ He never confessed to that. We didn’t have physical evidence. We didn’t have enough where we could go arrest him. University police and Columbia police both said they would not pursue charges against Phelps.

Michael_Phelps, 23, was the American swimmer, who won a record eight gold medals at the 2008 Olympic Games in Beijing, China.

For those of you who do not know, a bong is a device commonly used to smoke marijuana. University police and Columbia police both said they would not pursue charges against Phelps.

Lott defended his investigation, saying, “As a cop, my responsibility is to enforce the law, not to create it or ignore it. Marijuana in the state of South Carolina is illegal.”

    I don’t care who he is he is just as guilty as everyone else in the room and that is a fact.
    He should be arrested just as much as everyone else was because it is like gang rape everyone gets arrested that should hold true for this as well and that is a fact.
    This boy should pay for what he did and that is a fact. Just because he who he is doesn’t excuse what the did and that is a fact.
    What kind of signal is that giving to all other people who do things like this? It is OK you can do anything you want to and get away with it.
    He needs to be put into jail TODAY just like everyone else did and that is a fact.
